Terms of service

These terms govern the services you purchase from Advanced Digital Online Pty Ltd ("Advanced Digital", "we"), a company registered in South Africa. By ordering a website package or signing up for hosting you agree to them, so please read them together with our refund & cancellation policy.

Our services

We sell once-off website design packages and monthly web hosting plans (currently R149 or R249 per month). Website packages are a once-off purchase; hosting is a month-to-month subscription with no fixed term. All prices are quoted in South African Rand and are the total amount payable — we are not currently registered for VAT, so no VAT is added.

Your account

You must give us accurate contact and billing details and keep them up to date — we use them to bill you and to send notices about your services. You must be at least 18, or duly authorised to act for the business you represent.

Fees & billing

Hosting is billed monthly in advanceby recurring card payment through our payment processor. If a payment fails we will retry and notify you; continued non-payment may lead to suspension of the service. If we change the price of a hosting plan, we will give you at least 30 days' notice by email before the new price applies, and you may cancel before it takes effect. Once-off website work is quoted per project, with the deposit and payment schedule set out in your quote.

Hosting activation & cooling-off

Hosting is activated immediately when you sign up — by signing up you expressly request and consent to this. Because the service begins with your consent, the statutory 7-day cooling-off right under section 44 of the Electronic Communications and Transactions Act does not apply to hosting. In its place we voluntarily offer the 7-day money-back guarantee described in our refund & cancellation policy.

Website packages

The scope of a website package is defined by your quote. Amounts paid for project work are non-refundable once work has commenced. On receipt of full payment, all intellectual-property rights in the bespoke website material we created for you transfer to you — excluding third-party software, fonts, plugins and licences, which remain subject to their own licence terms. Until full payment, the website remains ours.

Domains, SSL & third-party services

Hosting plans may include a free domain registration. While your hosting is active we renew the domain on your behalf. If you cancel hosting there is no charge or clawback for the free domain — we simply stop renewing it, the domain lapses at the end of its current registration period, and you may ask us before then to transfer it to your own registrar account. Domain registrations, SSL certificates and other third-party licences are paid to third parties upfront and are non-refundable.

Acceptable use

You may not use our services to host or send anything unlawful, infringing, deceptive or harmful — including spam, malware, phishing content or material that violates the rights of others — or to abuse server resources in a way that degrades the service for other customers. We may suspend or terminate services for breaches of this section, without refund.

Suspension & termination

We may suspend or terminate a service for non-payment or for a breach of these terms. Where reasonable we will warn you first and give you a chance to put things right.

Your responsibilities

You are responsible for the content you supply for your website — it must be accurate, lawful and yours to use. Please keep your own copies of any material you provide to us.

Privacy

We process personal information in line with POPIA, as described in our privacy policy.

Liability

We provide our services with reasonable skill and care, but to the extent the law allows, we are not liable for indirect or consequential loss, and our total liability for any claim is limited to what you paid us for the affected service — for project work, the project price; for hosting, the fees paid in the three months before the claim arose. Nothing in these terms excludes liability that cannot lawfully be excluded under the Consumer Protection Act.
